MINT MED, LLC ("MINT MED," "WE," "US," OR "OUR") PROVIDES A PLATFORM TO CONNECT YOU WITH LICENSED HEALTHCARE PROVIDERS. WE DO NOT PROVIDE MEDICAL SERVICES OURSELVES NOR CREATE A PHYSICIAN-PATIENT RELATIONSHIP WITH YOU. MEDICAL SERVICES ARE DELIVERED BY INDEPENDENT, LICENSED PROVIDERS IN YOUR STATE THROUGH OUR NETWORK.

THESE SERVICES MAY NOT SUIT ALL MEDICAL NEEDS. FOR EMERGENCIES, CALL 911 IMMEDIATELY—DO NOT USE THE SERVICES FOR URGENT CARE. MINT MED IS NOT LIABLE FOR YOUR ACTIONS OR INACTIONS BASED ON SERVICE USE.

ARBITRATION NOTICE: THIS AGREEMENT REQUIRES BINDING INDIVIDUAL ARBITRATION FOR DISPUTES AND WAIVES YOUR RIGHT TO A JURY TRIAL OR CLASS ACTION (SEE SECTION 15).

Introduction

Mint Med operates www.mintmed.com (the "Website") and related services (collectively, the "Services"). These Terms of Service ("Terms") govern your use of the Services, alongside our Privacy Policy and applicable laws. Additional terms may apply to specific features—review and accept them as needed.

BY USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DISAGREE, DO NOT USE THE SERVICES. WE MAY UPDATE THESE TERMS AS DESCRIBED HEREIN.

1. Services Overview and Eligibility

What We Offer:

Access to licensed healthcare providers and pharmacy services via telehealth.
Tools and information for health and wellness (not medical advice).
Administrative support for scheduling, payments, and communication.
Mint Med connects you with providers but doesn’t guarantee outcomes or endorse specific treatments. Always consult a qualified professional for medical advice.

Availability:

The Services are for U.S. residents only. Access from outside the U.S. is at your own risk and subject to local laws.

Eligibility:

You must be:

18 or older (some services may require 21+).
Located in a state where we operate.
Able to comply with these Terms.
We may refuse service at our discretion. You’ll need compatible devices, internet access, and mayiml

2. Telehealth Services

We facilitate online visits with independent, state-licensed providers and mail-order pharmacy services via our platform. Telehealth uses electronic communication for consultations, not in-person care. Security measures protect your data, but no transmission is 100% secure—you accept this risk. Providers will seek your consent for telehealth services.

Mint Med is a platform, not a healthcare provider. You’re responsible for choosing your provider; we verify licenses but don’t guarantee their skills. Certify your state accurately—misrepresentation may lead to liability.

We don’t accept insurance; services are cash-pay only. You’re responsible for all costs, including third-party charges.

3. Registration and Accounts

You may need an account to use certain features. Keep your information accurate and secure your login details. Notify us at support@mintmed.com of any unauthorized use. We’re not liable for losses from your failure to protect your account.

4. Privacy

See our Privacy Policy for how we handle your data, incorporated here by reference.

5. Ownership and License

Mint Med owns the Services and their content (e.g., text, images). You get a limited, personal, non-commercial license to use them under these Terms. No other rights are granted. Trademarks remain ours—don’t use them without permission.

6. User Content

Content you submit (e.g., feedback, posts) becomes ours unless protected by privacy laws. We may use it for any purpose without compensation. Public posts are visible to others—Mint Med isn’t liable for their use. We may disclose content if legally required or to protect our rights.

7. Copyright Notices

We comply with the DMCA. To report infringement, contact support@mintmed.com with your signature, work details, location of issue, contact info, good-faith belief, and accuracy statement.

8. Restrictions

Don’t: impersonate, violate laws, reverse engineer, spread viruses, infringe rights, scrape data, sell Services, harm our reputation, harass providers, or bypass security. Violations may end your access.

9. Disclaimer of Warranties

Services are "as is." We disclaim all warranties (e.g., fitness, accuracy). We don’t guarantee uninterrupted or error-free use, nor endorse providers/pharmacies. Use at your own risk—we’re not liable for reliance on content.

10. Limitation of Liability

To the fullest extent allowed, Mint Med isn’t liable for indirect, special, or consequential damages (e.g., lost profits, injury) from Service use, even if warned. Total liability is capped at $100 or your 12-month payments, whichever is greater. Some states may limit this—those limits apply.

11. Indemnification

You’ll defend and indemnify Mint Med against claims from your unauthorized use, fraud, or Terms breaches, covering costs and fees.

12. Third-Party Links

We may link to third-party sites/services. We’re not responsible for their content or issues—use them at your risk.

13. Changes to Terms and Services

We may update Terms anytime—check back regularly. Changes apply upon posting unless law requires notice. Continued use means acceptance. Services may be modified or stopped without liability.

14. Payments

Pay all fees as presented. Prices may change. Authorize charges, including subscriptions, via your payment method. No refunds unless stated. You’re liable for all charges, even unauthorized ones if payment info isn’t updated. Subscriptions auto-renew—cancel per instructions provided at purchase.

15. Termination

These Terms last while you use the Services. You may stop anytime; we may terminate for any reason. Post-termination, key sections (e.g., Liability, Arbitration) survive. We may delete data per our policies unless legally required to retain it.

16. Governing Law; Dispute Resolution

  • Law: Delaware law governs, ignoring conflicts.
  • Arbitration: Disputes go to binding individual arbitration via AAA Rules, not courts, unless for small claims, IP, or injunctive relief. Start with a Notice to support@mintmed.com. Fees apply per AAA; we’ll cover yours under $10,000 unless frivolous. Hearings are at your billing address or online. Awards are final.
  • Class Waiver: No class actions or consolidations.
  • Time Limit: Claims must be filed within 1 year.
  • Severability: Unenforceable parts are adjusted to intent; rest stands.

17. Communications

Opting into SMS or email means you accept unencrypted messages (e.g., orders, provider notes). You’re responsible for charges and delays. Opt out by texting "STOP" or emailing help@mintmed.com. Contact us for issues.

By opting in to receive SMS messages from Mint Med, you agree to receive recurring autodialed marketing messages, including abandoned cart reminders and promotional texts, to the phone number you provided. Message frequency varies. Consent is not a condition of purchase. Message and data rates may apply.

To unsubscribe from SMS messages at any time, reply STOP. For help, reply HELP or contact us at help@mintmed.com.

Carriers are not liable for delayed or undelivered messages.

Changes to SMS Terms
We may update our Mobile Terms of Service at any time. Continued participation in our messaging program after any changes signifies your acceptance.

18. Miscellaneous

No waiver unless written. No agency exists. Violations may lead to injunctions. You can’t assign rights; we can. This is the full agreement, replacing prior ones.

Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, We take steps to remove that information from Our servers.

HIPAA Privacy Statement

Purpose:

Glow Medispa, LLC. (DBA: Mint Med) (DBA: Glow) (henceforth, “Glow Medspa”) upholds its’ duty to protect your privacy.  Under HIPAA we are required to provide the Notice of Privacy Practices.  This notice goes over how your protected health information (PHI) may be used and your rights to protect it.

The Notice of Privacy Practices is subject to change, at any given time.  All changes will reflect on this page, and will be accessible to anyone who has access to internet connection.  Upon your request, we can provide you with an electronic or paper copy.

Who:

All employees at Glow Medspa and all third-party affiliates are required to abide by this notice.  Which includes independent providers, customer support team, corporate staff, contracted employees, etc.

How We May Use and Disclose Health Information About You:

Glow Medspa will provide you with a consent form to complete.  This consent form is confirmation that we can use and disclose your PHI for treatment, payment, and operations use only.

Below are the following ways we may use or disclose your PHI for Treatment, Payment, and Operations:

Treatment:

Your PHI will be used to provide, coordinate, or manage your health care and any related services.  If required for treatment purposes, your provider may share your PHI with another provider added to your treatment plan.  Glow Medspa may use or disclose your PHI to external providers for treatment purposes only, such as laboratory, x-rays, or a specialist.  We may use your PHI to coordinate your care with a home health agency that provides care to you (if applicable).

Example:

When a patient receives a blood draw this is performed by a lab group who will have your PHI for treatment use.

If a patient is getting treated for diabetes and has to return to acute care for after surgery care, Glow Medspa would disclose the treatment for the diabetes to the assigned physician at the facility.

Payment:

PHI will be disclosed to health insurance plans for confirming the coverage of your health insurance and which services are covered.  Your PHI may be sent to health insurance plans to approve a service prior to it being performed or whether it is deemed necessary.  Pre-authorization requests with information about treatment that is planned would be sent prior to receiving this treatment.

Your protected health information will be used, as needed, to obtain payment for your health care services. This may include certain activities that your health insurance plan may undertake before it approves or pays for the health care services we recommend for you.  Examples are: deciding of eligibility or coverage for insurance benefits, reviewing services provided to you for medical necessity, and undertaking utilization review activities.

Example:

Annual physicals are only performed once a year, if you need one we would confirm that you did not have one performed in that given year.

Obtaining approval for a hospital stay may require that your relevant protected health information be disclosed to the health plan to obtain approval for the hospital admission. 

Healthcare Operations:

We may use or disclose your PHI for health care operations.  To provide you with the utmost of care, we use our patients’ experience and care to review the quality of care provided.  A few instances we would use your PHI for operational use are: appointment preference, services requested, location of care, and more.  We may use the services you received to ensure if we need more resources in place or additional providers who specialize for these services.  Your treatment and care may be evaluated to ensure our staff is caring for you properly.  Information we receive on care and treatment of patients may be used in training to provide better care for our patients.  Your PHI may be shared with our third party vendors for quality purposes.

Example:

If patients are more likely to schedule appointments for diabetes check in one location, we then would plan to have more resources and treatment for diabetes available.

Others Involved in Your Healthcare:

We may disclose your PHI to a member of your family, a relative, a close friend or any other you authorize to be involved in the health care plan. In situations where you are not able to agree or object to this disclosure, we may disclose this using our professional judgement. Additionally, your PHI may be disclosed or used to notify a family member, personal representative or caregiver.

Emergencies:

In the case of any emergency, we may use or disclose your protected health information. Your physician will try to obtain your consent before and/or after treatment.  In the instance, where the you are not able to provide consent the physician may need to disclose your PHI to your family, relative or any other caregiver to provide the correct treatment.

Abuse or Neglect:

In the case of reported abuse and neglect (child or elderly), we may disclose your PHI to a public health authority that is authorized by law to receive these reports. If you have been a victim of abuse, neglect or domestic violence we may be required to report this to the appropriate party in accordance to the federal and state laws.

Required By Law:

We may use or disclose your protected health information if required by federal, state or local law.  You will be notified if your PHI is used or disclosed in this instance.

Legal Proceedings:

We may disclose your PHI in the course of any judicial or administrative proceedings.  For example, in response to a subpoena, discovery request or other lawful process.

Law Enforcement:

We may disclose your PHI, if we believe that the use or disclosure is necessary to prevent or lessen a serious and imminent threat to the health or safety of a person or the public. We may also disclose protected health information if it is necessary for law enforcement authorities to identify or apprehend an individual. We may also disclose PHI for law enforcement purposes, such as: (1) legal processes and otherwise required by law, (2) limited information requests for identification and location purposes, (3) pertaining to victims of a crime, (4) suspicion that death has occurred as a result of criminal conduct, (5) in the event that a crime occurs on the premises of the practice, and (6) medical emergency (not on the Practice’s premises) and it is likely that a crime has occurred.

Inmates:

We may use or disclose your PHI if you are an inmate of a correctional facility. Your PHI will be disclosed to the correctional facility and/or the law enforcement official.  This disclosure is the ensure you receive similar treatment at the correctional facility if needed.

Military Activity and National Security:

When the appropriate conditions apply, we may use or PHI of individuals who are Armed Forces personnel for: (1) activities deemed necessary by appropriate military command authorities; (2) the purpose of a determination by the Department of Veterans Affairs of your eligibility for benefits, or (3) foreign military authority if you are a member. We may also disclose your protected health information to authorized federal officials for conducting national security and intelligence activities, including for the provision of protective services to the President or others legally authorized.

Workers’ Compensation:

We may disclose or use your PHI in the case of treatment or applying for workers’ compensation.

Public Health:

We may disclose your PHI to a public health authority.  This disclosure will be done on an as needed basis.  Examples include: controlling disease, injury or disability or if information is needed to prevent transmission of the disease.  If you are exposed to a contagious disease that is easily transmissible, we may disclose your information to protect others who may be at risk for contracting this disease.

Health Oversight:

We may disclose PHI to a health oversight agency for activities authorized by law, such as audits, investigations, and inspections. Oversight agencies seeking this information include government agencies that oversee the health care system, government benefit programs, other government regulatory programs and civil rights laws.

Food and Drug Administration:

We may by required, by the Food and Drug Administration (FDA), to disclose your PHI.  This disclosure will be relevant to any events that occurred related to Food or Drugs approved by the FDA.  Examples of such are: adverse events, product defects or problems, biologic product deviations, track products, to enable product recalls, or to conduct post marketing surveillance.

Coroners, Funeral Directors, and Organ Donation: 

We may disclose protected health information to a coroner or medical examiner for identification purposes, determining cause of death or for the coroner or medical examiner to perform other duties authorized by law. We may also disclose protected health information to a funeral director, in order to permit the funeral director to carry out their duties. We may disclose such information in reasonable anticipation of death. Protected health information may be used and disclosed for cadaveric organ, eye or tissue donation purposes.

Facility Directories: 

We may use and/or disclose your PHI in our facility directory only if you are under care at the facility.  The information that may be used and disclosed is not limited to: you name, where you are getting treatment, religious affiliation and your condition.  If someone comes into the facility asking for you by using your full name we may disclose the information above to them.  If a priest or clergy asks for you, your religious affiliation may be released to them.  You have a right to object to this use and disclosure.

Marketing:

We may use and disclose your protected health information for marketing activities. For example, your name and address may be used to send you a newsletter about our practice and the services we offer. We may also send you information about products or services that we believe may be beneficial to you. Research:

Your PHI may be disclosed and used for research.  Although research projects need to be approved by the institutional review board, your PHI may be disclosed to the researcher to ensure your information is needed for the project.  If your PHI is compatible with the research, after the project is approved the researchers will have a form or document available on how your PHI is protected.

Your Rights for Use and Disclosure of your PHI

You have the right to inspect and copy your PHI.

You may inspect and obtain a copy of your PHI that is contained in a designated record set for as long as we maintain the protected health information. A “designated record set” contains medical and billing records and any other records that your physician and the practice use.

However, under federal law you may not inspect or copy the following records; psychotherapy notes; information compiled in reasonable anticipation of, or use in, a civil, criminal, or administrative action or proceeding, and protected health information that is subject to law that prohibits access to protected health information. Depending on the circumstances, a decision to deny access may be reviewable. In some circumstances, you may have a right to have this decision reviewed. You have the right to request a restriction of your protected health information.

You may ask us not to use or disclose any part of your PHI for the purposes of treatment, payment or healthcare operations. You may also request that any part of your protected health information not be disclosed to family members or friends who may be involved in your care or for notification purposes as described in this Notice of Privacy Practices. Your request must state the specific restriction requested and to whom you want the restriction to apply to.

Your physician is not required to agree to a restriction that you may request. If physician believes it is in your best interest to permit use and disclosure of your PHI, your PHI will not be restricted, If your physician does agree to the requested restriction, we may not use or disclose your PHI unless it is needed to provide emergency treatment. Please discuss any restriction you wish to request with your physician. You have the right to request to receive confidential communications from us by alternative means or at an alternative location.

We will accommodate reasonable requests. You may have the right to have your physician amend your PHI.

You may request an amendment of your PHI in a designated record set for as long as we maintain this information. In the case the physician used his/her best professional judgement and does not agree with the amendment submitted, it may be denied. If we deny your request for amendment, you have the right to file a statement of disagreement with us and may prepare a rebuttal to your statement and will provide you with a copy of any such rebuttal. You have the right to receive an accounting of certain disclosures we have made of your PHI.

This right applies to Glow Medspa disclosing your PHI for non T.P.O. reasons.  It excludes disclosures we may have made to you, to the facility directory, family members or friends involved in your care. You have the right to receive the accounting of disclosures.  The right to receive this information is subject to certain exceptions, restrictions and limitations.

Complaints

If you feel that your privacy has been violated and need to report a complaint please notify Glow Medspa or the Secretary of the U.S. Department of Health and Human Services. We will not retaliate against you for filling a compliant.

Consent to Telehealth Services


Introduction

This Consent to Telehealth Services outlines the terms and conditions of using the telehealth services ("Services") provided by Glow Medispa, LLC doing business as Mint Med ("Mint Med"), through our websites and applications. By using these Services, you may obtain an online consultation with an independent, licensed healthcare professional ("Provider") and receive mail-order pharmacy services for any prescribed medications. Telehealth involves the delivery of healthcare services using electronic communications between a healthcare provider and a patient who are not in the same physical location.


Section 1: Telehealth Services

Telehealth services may include, but are not limited to:

  • Electronic transmission of medical records, photo images, personal health information, or other data between a patient and a Provider

  • Interactions between a patient and a Provider via audio, video, and/or asynchronous data communications, such as secure messaging and email

  • Use of data from remote monitoring devices, medical devices, and sound or video files


Section 2: Benefits of Telehealth

  • Easier, more efficient, and less expensive access to medical care

  • Receiving care and treatment at convenient times

  • Access to licensed Providers without requiring in-office appointments


Section 3: Limitations of Telehealth

  • Telehealth may provide insufficient information for appropriate medical decision-making, requiring in-person evaluation

  • Inability to conduct certain physical assessments may limit diagnostic accuracy

  • Potential delays in care due to technological issues

  • Possibility of data security breaches despite reasonable safeguards

  • Regulatory restrictions may limit available treatment options or prescriptions


Section 4: Patient Responsibilities

By agreeing to this Consent to Telehealth Services, you acknowledge and understand that:

  • You have read and understand the risks and benefits of telehealth

  • You give informed consent to receive medical care and treatment by telehealth from Mint Med's affiliated Providers

  • The technology used in telehealth consultations may include methods not specifically described in this document

  • No specific outcomes can be guaranteed; your condition may improve, remain the same, or worsen

  • You must provide honest and complete health information, and keep Providers updated on any changes

  • Providing inaccurate or incomplete information may result in serious harm or death

  • A Provider may determine that your case is not appropriate for telehealth and refer you for in-person care

  • Telehealth services support, but do not replace, your existing healthcare relationships

  • In a medical emergency, you must call 9-1-1 immediately


Section 5: Privacy and Data Security

  • Your personal health information will be handled in accordance with Mint Med’s Privacy Policy

  • You have the right to access your telehealth-related records in compliance with applicable laws

  • Health records will only be shared with other healthcare providers with your consent


Section 6: Consent Withdrawal

  • You may withdraw your consent to telehealth services at any time by emailing us with your request help@mintmed.com

  • Otherwise, this consent is deemed renewed with each new telehealth consultation with a Provider

"We," "us," and "our" refer to Mint Med. "You" and "your" refer to the individual using the Services.

Our Promises to You

MintMed recognizes telehealth services as an essential component of the healthcare infrastructure in the United States. However, we acknowledge the potential challenges in maintaining a strong connection between providers and patients in this remote setting. To uphold ethical standards and ensure both the quality of care and legal compliance, MintMed adheres to the following policies:

1. Licensing Compliance

  • All providers, doctors, nurses, and other such practitioners affiliated with MintMed are licensed and/or registered in good standing to engage in the practice of medicine and/or nursing in all jurisdictions in which they reside, and in jurisdictions in which they practice or render services to (such as the patient’s jurisdiction), except in circumstances allowed by law.

2. Controlled Substances Practices

  • All providers, doctors, nurses, and other such practitioners affiliated with MintMed maintain an up-to-date and valid US Drug Enforcement Administration (DEA) license and any requisite state licenses as per state or local law. Controlled substances are only prescribed when a clear medical need exists that cannot be adequately met by the use of a non-controlled substance in the provider’s professional opinion.

Due to the complex nature of pain and the necessity for extremely thorough monitoring greater than telehealth can provide, no providers, doctors, nurses, and other such practitioners affiliated with MintMed prescribe or dispense prescription pain medication (opiates and/or other narcotics) through telemedicine.

We do not, nor are we able to, facilitate the dispensing or prescribing of prescription pain medication (opiates and/or other narcotics). 3. Provider Quality & Disciplinary Actions

  • All providers, doctors, nurses, and other such practitioners affiliated with MintMed or to which patients are referred to are free from any significant recent and/or repeated disciplinary actions, sanctions, or similar. MintMed requires all affiliated providers to immediately notify our team in the event an affiliated provider is subject to any of the above actions.

4. Telemedicine & Establishing a Provider-Patient Relationship

  • All providers, doctors, nurses, and other such practitioners affiliated with MintMed will conduct a full telehealth review before establishing a diagnosis, or the writing and/or dispensing of any medication. A prescription will only be provided when:
  • a) The patient has a legitimate medical complaint
  • b) A face-to-face physical examination adequate to establish the legitimacy of the medical complaint has been performed by the prescribing practitioner, or through a telemedicine practice approved by the appropriate practitioner board; and
  • c) A logical connection exists between the medical complaint, the medical history, and the physical examination and the drug prescribed.

This definition establishes the bare minimum standards, and all providers, doctors, nurses, and other such practitioners affiliated with MintMed follow all applicable federal, state, and local laws regarding the practice of telehealth as required.

5. Legal Compliance

  • All providers, doctors, nurses, and other such practitioners affiliated with MintMed comply fully with state laws and regulations; the Federal Food, Drug, and Cosmetic Act; and the Federal Controlled Substances Act. We do not facilitate the prescribing or dispensing of, or offer to facilitate the prescribing or dispensing of, any commercial medications that have not been approved by the US Food and Drug Administration (FDA). Compounded medications are exclusively compounded at licensed 503(a) compounding pharmacies pursuant to Section 503A of the Federal Food, Drug, and Cosmetic Act.

6. Privacy

  • All medical documentation and protected health information is collected, stored, and maintained through Elation Health, which is HIPAA-compliant electronic health records systems. Elation uses encryption, double the level required by law, and their service is fully HIPAA-compliant.

The transmission of any information that would be considered Protected Health Information (PHI) under the HIPAA Privacy Rule (45 CFR 164) is in accordance with HIPAA requirements, including the use of equivalent technology for the transmission of PHI, and for any online transmissions.
